This year is proving to be a very important one. With the impending presidential election, a major political shift is about to take place in the White House. One act that is under consideration at this very moment may fundamentally change the way that business is conducted in the United States. It is called the Employee Free Choice Act. The act would make it easier for workers to Unionized in the United States. Workers can skip the National Labor Relations Board election and unionize through the signatures of the majority of workers on their authorization cards. Business owners are alittle put off by the measure. While proponents of the act say that it will help to enliven the ailing workers unions of America, business owners argue that such a dramatic shift in the law would ultimately harm businesses and eliminate jobs, thus jeopardizing the system of free enterprise. It is important to make sure that all individuals in the picture are being treated fairly. Employment law can be very tricky at times. If you would like more information on how this might might affect you and your family, take a minute to call the New York City employment lawyers of the Cary Kane firm at 212.868.6300.

Dozens of employees, who are in charge of caring for more than 100 disabled individuals have threaten their employer, Pinnacle Opportunities, to walk if their demands are not met. The workers complain that they are both understaffed and underpaid, which has thus resulted in a negative impact on patient care. The Unions and the employers have been in negotiations since July, however on September 15th, the union filed an intent to strike. There were some scheduling issues that kepted the two sides from meet more frequently about the issue of pay and work environment. Admittedly, the company did put together a proposal that would offer a $0.78 pay increase for most employees and a $0.90 pay increase for long-term employees. Most of the union members have not read the proposal. They have stated, however, that they would like to see a steady increase in pay each year of the three-year contract. It is absolutely imperative that employers respect the needs and wants of their employees. Business sometimes forget the importance of the individuals who put in the long hours to make them money. If you or someone you know would like more information on how employment law affect thier lives, contact the employment law attorneys of the Carey Kane law firm in New York at 212-868-6300.

Thirty-five progressive, loabor leaders came together to sign a letter of urgency to the United States government regarding the proposed $700 Billion wallstreet bailout plan. They have sternly expressed their concern and skepticism about the feasability and effectiveness of the plan. Representing more than 20 million American citizens, the letter urged leaders to drafts, at the very least, basic conditions before any kind of agreement is made. These leaders feel that this plan is dangerously close to the equivalent of a blank check to bail out the ailing economy. Furthermore, outrage is brewing due to the popular belief that the financial crisis was caused by the same individuals. They stress more so than anything else that accountability and oversight must be built into the foundation of the plan. There are entities all over the world that are waiting to find out what will happen with the United States economy. More importantly, what happens on wall street will ultimately affect what happens on mainstreet. The hard-working employees and tax payers of this country are most at risk. The most important thing is to make sure that these employees stay protected. For more information on how, the fate of these companies might affect you, visit www.carykanelaw.com or call 212 871-0540 to speak with an employment law attorney in the New York City area.

The New York labor commission has announced that backstretch workers at Saratoga Racetrack in upstate New York have been cheated out of roughly $70,000 collectively each week. The study finds that individuals who work in the back of the track including grooms, hot walkers, and security were not paid minimum wage or given time and a half for overtime.

Many grooms and other workers revealed that they were paid a paltry $5.06 an hour, well below the state minimum wage of $7.15 an hour. In addition, they reported unsanitary living conditions. Many individuals reported being bitten by bed bugs. Also, they were not paid enough to afford to eat at restaurants in Saratoga Springs and so resorted to dining at soup kitchens.

The state labor commission will hold meetings with trainers to ensure everyone knows what is required. They will also be in discussions with the commission governing horse racing in the state to determine if labor violations should be a reason to take away a trainer’s license.

If you have not been paid fairly, contact the New York City minimum wage lawyers of Cary Kane Law at 212-868-6300 to discuss your situation and to determine your legal options.

A Richmond, California motel has settled a discrimination case that stems from the 2004 firing of a woman.

At the time of the firing, the woman who was fired was 67 and black. She was replaced by a 29 year old Latina woman. Following the firing, the woman filed a complaint with the United States Equal Employment Opportunity Commission (EEOC). The EEOC ended up filing a lawsuit on her behalf.

In the suit, the woman alleged that she was fired due to her age. The EEOC enforced federal anti discrimination laws. The company settled for $25,000 with the woman.

Boeing has stopped plane construction following a strike by 27,000 workers who were members of the International Association of Machinists and Aerospace Workers (IAM). The strike occurred after talks between the labor union, the company, and a federal mediator failed to produce a new labor agreement.

According to Boeing, the strike will affect plants in Kansas, Washington State, and Oregon. The company will continue to deliver already-complete planes and will furnish companies with spare parts but will not work on any planes currently in production.

Some analysts are viewing the strike as risky on the part of the labor union, given the predicted market slowdowns. Boeing will also, most likely, suffer from this as it means further delays for its new plane model that is already significantly behind schedule.

Employees of aviation-giant Boeing have voted to go on strike after rejecting the latest offer from the company.

The strike was voted for by 87% of assembly workers. It was due to start Thursday but was postponed for 48 hours once Boeing agreed to extend the current contract by two more days. The extension came at the request of Washington Governor Chris Gregoire. He is currently attempting to broker a deal between the two groups.

The unions and management have disagreed over basic pay, health benefits, pension increases, and cost of living adjustments. If Boeing fails to come up with a new, and accepted, proposal within the 2 day extension, some 27,000 workers will go ahead with the planned strike.

If the workers strike, it could mean more delays to Boeing’s Dreamline 787 jet. The plane has already faced a number of costly delays. Currently, it is about 15 months behind schedule. The maiden flight will take place sometime later this year. The first delivery of the plane is tentatively scheduled for mid-2009.

The Orland Park Fire Department is offering a retirement package to its battalion chiefs that reportedly can save the district $300,000 over the next five years.

The Fire Department has been re-organizing its upper management for the majority of the year. This plan fits in with the organization. The Fire Chief was sure to point out that it had nothing to do with the people in the positions but more to do with the positions.

Battalion chiefs who qualify and want to retire have until October 1st to accept a retirement incentive package. To qualify, a chief must have a minimum of 25 years of full-time experience and become fully eligible for a pension as of his 50th birthday. The chiefs then have to agree to retire by their 50th birthday or their 30th anniversary with the district, whichever comes later.

The firefighters’ pension fund allows for regular retirement when a member reaches age 50 with 20 years of service. The pension benefits available to an individual increase with the number of years of service. The maximum pension benefit is reached when a person has 30 years of service.

If you are going through a dispute over a pension benefits package, contact the New York City pension dispute lawyers of Cary Kane at 212-868-6300.
