A sexual harassment suit that was first filed in 2004 may be finally wrapping up. The suit was originally filed by Kendra Lynn of Kansas City, Missouri, against TNT Logistics of North America Inc. The suit claims that Lynn’s shift supervisor, Michael Gill, repeatedly made lewd an inappropriate comments to her. When Lynn filed a complaint with the company, she was moved to another shift and eventually fired. In a new legal precedent for her state, she filed her suit under the Missouri Human Rights Act, rather than in a federal court. Although the Act now names limits on punitive damages, it did not when she filed her suit.
The amount of punitive damages to be paid to Lynn has been changed repeatedly in appeals courts, from $6.75 million to $450,000. The most recent amount set by an appeals judge is $3.75 million. Lynn’s attorney has reported that she will most likely accept the amount.
